Welcome to Biblical Solutions. These Terms of Service (“Terms”) govern your use of our website at biblical.solutions, our client portal, and the counseling, discipleship, and related ministry services we provide (together, the “Services”). Please read these Terms carefully. By accessing our website, creating a portal account, submitting information to us, or engaging our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. Who We Are and the Nature of Our Services
Biblical Solutions is a Christ-centered, nonprofit biblical counseling and discipleship ministry. Our Services are spiritual and pastoral in nature, grounded in Scripture and the Christian faith. We provide biblical counseling, discipleship, premarital preparation, and related ministry care.
Important — please read carefully.
Biblical Solutions provides biblical and pastoral ministry, not licensed professional counseling, psychotherapy, psychological services, or medical care. Our counselors are not acting as, and do not hold themselves out as, professionals licensed by the Texas Behavioral Health Executive Council or the Texas State Board of Examiners of Professional Counselors. We provide ministry as recognized religious practitioners and as a nonprofit religious organization, consistent with the exemptions in the Texas Occupations Code (including §§ 503.054 and 503.056). Nothing we provide should be understood as a diagnosis or treatment of any medical, psychological, or psychiatric condition.
Our Services are also not legal advice, financial advice, or a substitute for the professional services of a physician, psychologist, licensed counselor, attorney, or financial professional. If you need any of those services, we encourage you to seek a qualified, licensed professional, and we are glad to help you think through doing so.
2. Not for Emergencies
Biblical Solutions does not provide emergency or crisis services. If you or someone else is in danger or experiencing a medical or mental-health emergency, call 911 immediately, or call or text 988 (the Suicide & Crisis Lifeline) for free, confidential support 24/7. Do not use our website, forms, or portal to communicate an emergency, because they are not monitored in real time.
3. Eligibility
You must be at least 18 years old to create an account or enter into these Terms on your own behalf. Where our Services involve a minor, a parent or legal guardian must provide consent and be involved as appropriate. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.
4. Consent to Minister (“Right to Minister”)
Before counseling or discipleship begins, we ask each counselee to review and sign our “Right to Minister” consent document, which explains the spiritual and biblical nature of our ministry and your voluntary participation in it. Your engagement in the Services is voluntary, and you may discontinue at any time. The “Right to Minister” document is part of your agreement with us, together with these Terms and our Privacy Policy.
5. Confidentiality and Its Limits
What you share with us is held in confidence and used only to help your counselor care for you. Because Biblical Solutions is a ministry rather than a licensed professional practice, this confidentiality is a commitment of ministry ethics rather than a statutory medical or therapeutic privilege, and we are not a HIPAA-covered entity. We take it seriously nonetheless.
Texas law and ethical responsibility require us to act, including by disclosing information without your consent, in the following situations:
- Suspected abuse or neglect of a child. Under Texas law (Tex. Fam. Code § 261.101), any person, including clergy, who has cause to believe that a child has been or may be abused or neglected must report it to the proper authorities. This duty applies without exception, even to communications that would otherwise be privileged.
- Suspected abuse, neglect, or exploitation of an elderly person or a person with a disability, which must be reported under Texas law (Tex. Hum. Res. Code Ch. 48).
- Serious and imminent risk of harm. If we reasonably believe you or another identifiable person is at serious risk of harm, we may take reasonable steps to protect safety, which may include contacting emergency services, your emergency contact, or others who can help.
- Legal process. If we are required to disclose information by a valid court order, subpoena, or other legal process.
We may also share information with your written consent, or with trusted service providers who help us operate the ministry, as described in our Privacy Policy. Confidential communications made to a member of the clergy in a spiritual capacity may be privileged under Texas law (Tex. R. Evid. 505), but that privilege does not relieve us of the mandatory-reporting duties described above.
6. Use of Artificial Intelligence (AI)
We use AI-assisted tools to support the administration and operation of the ministry, such as drafting and organizing communications, summarizing or formatting information, transcription, scheduling support, and document preparation. By using the Services, you acknowledge and agree that:
- AI tools support, but do not replace, the judgment and care of your counselor. AI does not provide your counseling and does not make spiritual or pastoral decisions.
- A person reviews AI-assisted work; AI output may be inaccurate or incomplete and is not professional medical, legal, financial, or mental-health advice.
- Where AI tools may involve your personal information, we use reputable providers and take reasonable steps to protect your information, including limiting access and seeking to prevent your information from being used to train third-party public AI models, as further described in our Privacy Policy.
- You may ask that your sensitive counseling information not be processed by AI-assisted tools, and we will honor reasonable requests to the extent practical.
7. Client Portal and Accounts
Some Services are accessed through our client portal, where you can view documents, manage your account, review giving history, and sign forms electronically. You agree to:
- Provide accurate information and keep it current;
- Keep your login credentials secure and not share them;
- Accept responsibility for activity that occurs under your account; and
- Notify us promptly of any unauthorized use.
Electronic signatures you provide through the portal (for example, through BoldSign) are valid and binding. You agree to receive documents, notices, and disclosures electronically. We may suspend or close an account that is misused or used in violation of these Terms.
8. Fees, Donations, and Payments
Counseling sessions are 90 minutes and are offered for a fee, which is disclosed to you before you schedule. Payment is required at the time you schedule a session. We want our care to be accessible; if the full fee is a hardship, please reach out to us through the portal so we can talk it through. Biblical Solutions does not accept insurance or HSA/FSA.
Payments and donations are processed by third-party processors (such as Stripe and GiveWP), and your use of those services is subject to their terms. Counseling fees are not tax-deductible. Voluntary contributions given over and above any counseling fee are tax-deductible to the extent the law allows, as Biblical Solutions is recognized as a tax-exempt organization under section 501(c)(3) of the Internal Revenue Code (EIN 83-0703748). Please consult your tax advisor.
9. Scheduling, Rescheduling, and Cancellations
Our calendar is open on a 90-day rolling basis. After you schedule a session, you will receive confirmation and reminder messages by email and text that include links to reschedule or cancel.
Cancellation policy: Session fees for appointments canceled less than 24 hours in advance will not be refunded or applied toward any rescheduled or future appointment. Emergencies will be considered on a case-by-case basis. We ask that you give as much notice as possible when you need to cancel or reschedule so that we can serve others well.
10. Acceptable Use
You agree not to use the Services to:
- Violate any law or the rights of others;
- Submit false, misleading, or harmful information;
- Upload malicious code or attempt to disrupt, probe, or gain unauthorized access to our systems;
- Harass, threaten, or harm any person; or
- Use our content or materials in a way these Terms do not permit.
11. Intellectual Property
The content on our website and in our materials, including teaching series, study guides, written materials, graphics, and the “Biblical Solutions” name and logo, is owned by or licensed to Biblical Solutions and is protected by law. You may use materials we provide for your own personal, non-commercial ministry growth. You may not copy, distribute, sell, or create derivative works from our materials without our written permission, except as expressly allowed.
12. Disclaimers
The Services and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any particular spiritual, emotional, relational, or other outcome will result from participation. Ministry care depends on many factors, including your own participation, and we make no guarantees of results.
13. Limitation of Liability
To the fullest extent permitted by law, Biblical Solutions and its directors, officers, counselors, volunteers, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, for the Services giving rise to the claim during the twelve (12) months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Biblical Solutions and its directors, officers, counselors, volunteers, and staff from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Services will be resolved in the state or federal courts located in Potter or Randall County, Texas, and you consent to the jurisdiction of those courts. We encourage you to first contact us directly so we can try to resolve any concern in good faith and, where appropriate, in a manner consistent with biblical principles of reconciliation.
16. Termination
You may stop using the Services at any time. We may suspend or end your access to the Services, or to any account, at our discretion, including if these Terms are violated or if continuing would be inconsistent with the mission or integrity of the ministry. Provisions that by their nature should survive termination will survive.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
